NANCI CLARENCE DISCUSSES SENTENCING IN WHITE COLLAR CASES

Nanci Clarence was quoted extensively in a July 24, 2013 story published by the Daily Journal about the upcoming meeting of the U.S. Sentencing Commission in which the presidentially-appointed federal judges and attorneys will consider possible reforms of the guidelines for economic crimes. “It all goes back to this idea that the amount of the loss should drive the base offense level that determines sentencing guidelines.” The story noted that “Clarence would like to see guidelines that evaluate the likelihood of re-offending, and have less emphasis on loss and more on the fraud’s real harm, rather than what she calls a ‘formulaic mathematical calculation that as far as I can tell was just picked out of air.’”
